SYNOPSIS:
On December 7, 2010, Tuesday, 39 year old, Earl Edward Wallner was sentenced by Honorable Judge Monica Marlow to 7 years in State Prison on one (1) felony count of 288.5 PC ~ continued sexual abuse of a minor under age 14, and one (1) felony count of 288(c)(1) PC ~ sexual abuse of a minor under 14 or 15 years old, where the suspect is 10 years older than the victim. A Shasta County Jury of 12 found Earl Wallner guilty of the charges on October 28, 2010.
Earl Wallner was arrested on October 6, 2009 after being accused of continually molesting the now 16 year old female. This investigation included accusations of child sexual abuse, which began in approximately 2005 in Missouri and then continued as he moved his family to New Mexico. The abuse continued until 2009, when after moving to Shasta County, it was reported to the Shasta County Sheriff’s Office. The case was investigated by Shasta County Sheriff’s Detective Steven Curtiss and later prosecuted by Shasta County Deputy District Attorney, Curtis Woods.
The abuse had, in the past, been reported to law enforcement and social services in other jurisdictions; however the family would either successfully convince the victim to recant on her statements or, the family would move from the jurisdiction in order to evade any further investigation. At the time of the report to the Shasta County Sheriff’s Office, the family was again in the process of moving.
