    Terry V Ohio backs the search of the backpack he was attempting to access after repeated advisements not to. Throw in the fact it occurred during a traffic stop and different set of rules can also apply. This will not be tossed unless it can be proved the grounds for the initial traffic stop lacked reasonable suspicion or probable cause.

    Arizona v Gant forbids Terry frisks of the passenger compartment once the suspect can no longer reasonably reach the area being searched. A closed backpack under the seat of a car the suspect no longer has immediate access to is not a threat to the officer and thus cannot be frisked.

    Before this gets to deep into the weeds, this is a press release, not a statement of facts, for sure there will be a motion hearing on this very topic, there always is. Courts have overwhelmingly allowed searches during car stops where issues of officer safety comes into play. It would be easily articulable in this situation, then ultimately proven to be a valid one upon the discovery of the weapons inside, which would not be a requirement to justify the search.

      Yeah I liked that too — “don’t make me violate my parole!”
      That plus driving around with a bunch of illegal drugs & guns in a car with expired registration and I’d say we’re dealing with a world-class mastermind here…

      PS: A heroin dealer with suboxone – is that for him or his clientele? And where is the rifle that goes with the .308 ammo?

    If you see police lights in your rear view mirror, pull over as soon as it is safe, turn off the ignition and put your hands at 10 and 2 and do not move them under any circumstances until directed by the officer. Do not roll down the window until directed by the officer. Do not put the leash on your dog until directed by the officer. You want the officer to feel as safe as possible. Perhaps if he is in a good mood, you will get a warning. I only get stopped by the police about every 15 years and half the time got a warning. My car was never searched.

    If you do get a ticket and it was deserved, your remedy is to pay it. If your ticket was not deserved take it to traffic court.

    Where did this man go to high school that he does not know how to behave when the police pull you over?
